Preview Tool Terms

These Preview Tool Terms govern the demonstration, trial, evaluation, and preview tools that WeProgram, LLC (d/b/a Upleveled Industries), a Puerto Rico limited liability company (“Upleveled Industries,” “we,” “us,” or “our”) makes available on this site (each, a “Preview Tool”). They apply in addition to our Terms of Use and Privacy Policy. Where these terms conflict with the Terms of Use as to a Preview Tool, these terms control.

Please read the section titled “How We Use What You Submit” before uploading anything.

What a Preview Tool Is

A Preview Tool is software we make available at no charge so you can see what our products do. It is not a production service. We make no commitment as to its availability, accuracy, performance, or continued existence, and we may change or withdraw any Preview Tool at any time without notice.

How We Use What You Submit

Content you submit to a Preview Tool is not confidential. By uploading, entering, or otherwise submitting any file, drawing, data, text, or other material to a Preview Tool (“Submitted Content”), you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, and create derivative works of that Submitted Content for any purpose, including to operate, evaluate, benchmark, and improve our products and services, and to train, fine-tune, and evaluate machine learning models.

We will not publish Submitted Content in a form that identifies you or your organization without your prior written consent.

If you do not want your material used this way, do not submit it to a Preview Tool. Contact us instead and we will arrange a confidential evaluation under a non-disclosure agreement.

Your Responsibilities

By submitting content to a Preview Tool you represent that:

• you own the Submitted Content or have all rights necessary to submit it and to grant the license above;
• submitting it does not breach any obligation you owe to any other person, including any confidentiality or non-disclosure obligation; and
• the Submitted Content does not contain payment card or cardholder data, financial account or routing numbers, government-issued identification numbers, protected health information, biometric data, or data relating to children.

You are responsible for removing or masking anything you are not free to share. This includes material belonging to your own customers.

Relationship to a Non-Disclosure Agreement

If you have signed or later sign a non-disclosure agreement with us, that agreement does not cover Submitted Content. Content submitted to a Preview Tool is governed solely by these terms, whether it was submitted before or after that agreement was signed. Confidential information exchanged with us directly, outside a Preview Tool, remains governed by that agreement.

Automated and AI-Generated Output

Preview Tools produce output using automated and machine learning systems. That output may be incomplete or wrong. It is provided for demonstration only.

Do not rely on Preview Tool output for production work, and do not use it to cut material, place an order, quote a job, or make any other operational or commercial decision. Verify everything independently.

No Warranty

Preview Tools are provided “AS IS” and “AS AVAILABLE,” without warranty of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost revenue, business interruption, scrapped or damaged material, rework, or lost or cancelled work, arising out of or relating to your use of a Preview Tool — even if we have been advised of the possibility. Our total liability arising out of or relating to any Preview Tool will not exceed one hundred dollars ($100).

Changes

We may change these terms at any time by posting a revised version on this page. The version in effect when you submit content governs that submission.
